Welcome to Botfyre, an enterprise SaaS platform operated and billed by ByteBeez Technologies ("we," "our," or "us"). By accessing our website, creating an account, connecting documents, embedding our widgets, or subscribing to our software-as-a-service ("SaaS") platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our services.
1. The Platform & Nature of Services
Botfyre provides an autonomous enterprise knowledge retrieval and conversational assistant system. Our platform allows users to ingest unstructured corporate files (including PDFs, DOCX, XLSX, and live website sitemaps) into private vector search indexes, generate natural language answers with exact document page citations, and deploy chat widgets across digital surfaces.
2. Account Registration & Security
- You must provide accurate, current, and complete information during registration.
- You are responsible for safeguarding your login credentials and API secret keys. Any activity occurring under your authenticated credentials is your sole responsibility.
- You must notify us immediately at support@botfyre.com upon discovering unauthorized account access or security breaches.
3. Subscription, Billing & Payment Processing
- Billing Cycles: Paid subscriptions (Starter, Professional, Enterprise) are billed in advance on a recurring monthly or annual basis, as selected by you upon checkout.
- Payment Processors: All monetary transactions and recurring auto-debits are processed securely via authorized third-party payment gateways (including Razorpay and Stripe). We do not store full credit card numbers or sensitive CVV codes on our servers.
- Currency & Taxes: All fees are stated in either USD ($) or INR (₹) depending on your locale, exclusive of applicable statutory taxes (such as GST or VAT), which are calculated at checkout where legally required.
- Non-Refundable Active Periods: Subscription payments are non-refundable. Cancellations prevent future renewals, but no refunds or pro-rated credits are granted for unused portions of an already active billing cycle.
4. Intellectual Property & Customer Data Ownership
- Your Literature Belongs to You: You retain complete, unencumbered ownership and intellectual property rights over all files, documents, text, and materials ingested into Botfyre.
- Zero Model Training: Botfyre explicitly does not use your private enterprise documents, indexed vectors, or customer conversation logs to train, retrain, or fine-tune public foundation AI models.
- Platform IP: The Botfyre software, website, algorithms, user interfaces, branding, and proprietary retrieval pipelines are protected by copyright, trademark, and trade secret laws.
5. Acceptable Use Policy
You agree not to use Botfyre to:
- Upload, index, or distribute unlawful, defamatory, infringing, or malicious content.
- Reverse engineer, decompile, or attempt to extract the source code or proprietary embeddings of the service.
- Attempt denial-of-service (DoS) attacks, scrape data, or bypass rate-limiting restrictions.
- Use the conversational engine to intentionally propagate fraudulent statements or impersonate licensed professionals without disclosure.
6. Service Level, Availability & Disclaimer
While we strive for 99.9% service uptime across our global cloud infrastructure, the platform is provided on an "as is" and "as available" basis. Botfyre does not warrant that service will be completely uninterrupted or error-free during scheduled maintenance, third-party cloud outages, or upstream model API disruptions.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Botfyre and its directors, employees, and licensors shall not be liable for any indirect, incidental, punitive, or consequential damages, or loss of profits, revenue, data, or goodwill resulting from your use or inability to use the platform. Our aggregate liability shall not exceed the amount actually paid by you to Botfyre in the three (3) months preceding the incident.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts located in Assam, India.
9. Amendments to Terms
We reserve the right to revise these Terms at our discretion. Notice of substantial updates will be communicated via email or an in-app banner at least fifteen (15) days prior to taking effect. Continued use of the platform following notification constitutes your acceptance of the amended Terms.
